Public offer

The document, the provisions of which are set out below, is a public offer.
According to the provisions of Art. 633, 641 of the Civil Code of Ukraine, the terms of a public offer and a public contract are the same for all Customers (Customers). In accordance with Part 2 of Art. 642 of the Civil Code of Ukraine, making an online booking is an acceptance of this offer, which is equivalent to concluding a contract on the terms set out below in the text, as well as the provisions of the Privacy Policy. The Privacy Policy regulates the features of the processing of the Customer's personal data by the Customer. You can familiarize yourself with the provisions of the Company's Privacy Policy by following the link. The Privacy Policy is an integral part of these Terms.
This public offer is addressed to all individuals and legal entities who wish to use the service and have the technical ability to receive the service.
Hotel "Kyivska Russ Resort Medical&Spa" LLC "Paradis Service", (hereinafter referred to as the Contractor), on the one hand, guided by the current legislation of Ukraine, offers (public offer) to an individual and/or legal entity (hereinafter referred to as the Customer), hereinafter jointly referred to as the Parties, and each individually referred to as a Party, to conclude a public contract for the provision of services (hereinafter referred to as the Contract) on the following terms:
1. TERMS
1.1. Public offer – a formal offer of the Contractor (published on the Contractor's website), addressed to an unlimited number of individuals and legal entities, to conclude a Contract on certain terms.
1.2. Acceptance – full, unconditional and unreserved acceptance by the Customer of the terms of the Public Offer Agreement. Acceptance may be made in one of the following ways:
– filling out, signing and handing over the Guest Registration Card by the Customer to the Contractor;
– payment for temporary accommodation services through the reception and accommodation service (reception) or by bank transfer based on issued invoices, or by bank card;
– direct use of the Hotel services by the User (accommodation);
Any of the actions specified in clause 1.3, performed by the Customer, indicates that the Customer is familiar with this Agreement and agrees with its terms in full.
1.3. The Contractor's website is a web page on the Internet, at the address https://kyivskaruss.com.ua/, which is the main source of information for Customers.
1.4. Customer – an individual who has accepted the Contractor's Public Offer set out in this Agreement and paid the cost of the relevant services.
1.5. The Rules of the Hotel "Kyivska Russ Resort Medical&Spa" - the terms of service provision, which are chosen by the Customer within the framework of this Agreement, are its integral part and, together with this Agreement, are the sole source of regulation of all relations between the Customer and the Contractor, arising in the process of providing services. All advertising, presentation and other materials created and existing for the purpose of informing about the Contractor's services are for informational and reference purposes only and are not a source of regulation of all terms of service provision.
2. PROCEDURE FOR CONCLUSION OF THE CONTRACT
2.1. The Agreement is concluded between the Hotel and the User in the form of an accession agreement (Article 634 of the Civil Code of Ukraine).
2.2. Acceptance of the Public Offer is the User's performance of any of the actions specified in clause 1.2 of the Agreement.
2.3. Acceptance of the Public Offer means the User's full, unconditional and unreserved acceptance of all terms and conditions of the agreement without any exceptions and/or limitations and is equivalent, according to Part 2 of Article 642 of the Civil Code of Ukraine, to the conclusion by the Parties of a bilateral written agreement on the terms set out in this Public Offer.
Concluding the contract means that the User:
– has fully read and agrees with the rules of accommodation at the Hotel;
– acknowledges the unconditional suitability of the Hotel premises to meet the needs described in this agreement;
– accepts all the terms of this agreement without comments or objections.
2.4. The User undertakes to independently enter (report) reliable personal data and information that correspond to reality when registering for the Hotel's services.
2.5. The term of acceptance of this Public Offer is unlimited.
3. SUBJECT OF THE CONTRACT
3.1. In accordance with the procedure and on the terms specified in this Agreement, the Contractor undertakes to provide the Customer or third parties specified by the Customer in accordance with the reservation, hotel services, namely: temporary accommodation and temporary residence services at the hotel "Kyivska Russ Resort Medical&Spa", which is located at the following address: Ukraine, Lviv region, Skhidnytsia, Tarasa Shevchenko str., 2a
3.2. The list of services under this Agreement is posted on the official website of the Contractor.
4. PAYMENT FOR SERVICES
4.1. The right to stay at the Kyivska Russ Resort Medical&Spa hotel is granted to the Customer after payment for the Contractor's services and registration at the reception before arrival.
4.2. The Customer shall promptly and in full pay the cost of the services provided to him, according to the tariffs established by the Contractor in the form of prepayment. In the event of the Customer's violation of the Rules of the Kyivska Russ Resort Medical&Spa hotel or the terms of this Agreement and, as a result, the unilateral termination of the agreement by the Contractor, the amount paid by the Customer for the services shall not be refunded.
4.3. The cost of services under this Agreement is posted on the official website of the Contractor.
4.4 Additional services are provided at the rates/prices indicated on the information stands, menus, price lists, price lists, other information documentation of the Hotel and/or on the Hotel's website, taking into account the selected room category.
5. RIGHTS AND OBLIGATIONS OF THE PARTIES
5.1. The Contractor has the right:
5.1.1. Receive payment for services in full in accordance with the terms of this Agreement.
5.1.2. Do not allow the use of services, or terminate the provision of services to persons in a state of alcoholic or drug intoxication, and in other cases, without explaining the reasons for the refusal to provide services, if, in the opinion of the Contractor's employees, this person raises doubts about his ability to adequately understand and manage his actions and strictly comply with the terms of this Agreement and the Rules of Residence at the Kyivska Russ Resort Medical&Spa hotel.
5.1.3. In the event of a gross or repeated violation of the terms of this Agreement, failure by the Customer to respond to the remarks of the Contractor's employees, if the Customer's actions create a danger to the health, property, honor or dignity of other Consumers, or to the Contractor's employees, the Contractor has the right to stop providing services to such a Customer, block his illegal actions, and offer to leave the visiting area. In the event that the Customer commits actions that have signs of an administrative or criminal offense, the Contractor's employees in such a case have the right to act in accordance with the requirements of the current legislation of Ukraine in relation to this Customer and call representatives of law enforcement agencies.
5.1.4. To unilaterally make changes to this Agreement with their prior publication on the official website of the Contractor.
5.1.5. To openly take photos and videos of the Customer during his stay in public places on the territory of the hotel "Kyivska Russ Resort Medical&Spa".
5.1.6. Involve third parties in the provision of services under this Agreement.
5.1.7. The Contractor reserves the right, at its own discretion, to accommodate the Guest in another room of the same or higher level (category).
5.1.8. In the event of destruction or damage to property, the Customer shall be charged full compensation for damages caused to the hotel, in accordance with the approved price list.
5.1.9. To refuse the Customer accommodation or terminate the contract (evict) in cases of violation of this Agreement and/or the Rules of Residence at the hotel "Kyivska Russ Resort Medical&Spa".
5.2. The Contractor undertakes to:
5.2.1. Provide the Customer with the opportunity to receive services of appropriate quality in accordance with this Agreement and the Rules of Accommodation at the Kyivska Russ Resort Medical&Spa Hotel.
5.2.2. Provide the Customer with the opportunity to obtain information on the provision of services.
5.3. The Customer has the right:
5.3.1. Receive the ordered services in full and of proper quality, taking into account the operating hours established by the Contractor.
5.3.2. To receive necessary and reliable information about the Contractor and other information related to the provision of services in accordance with the current legislation of Ukraine.
5.3.3. On its own initiative, make payments to the Contractor ahead of schedule.
5.4. The Customer is obliged to:
5.4.1. Before paying for services, read the Rules of Accommodation at the Kyivska Russ Resort Medical&Spa Hotel and the terms of the Public Offer Agreement, and unconditionally comply with the terms of this
Agreement throughout the entire period of use of the services.
5.4.2. Provide complete and accurate information necessary to identify the Customer.
5.4.3. While staying on the territory of the hotel "Kyivska Russ Resort Medical&Spa", do not violate the requirements of the current legislation of Ukraine and generally accepted norms of morality and
morality.
5.4.4 Be liable to the Contractor for compensation for damages caused in accordance with the provided invoice and act on damage to property (damage).
6. RESPONSIBILITY OF THE PARTIES
6.1. For violation of the terms of this Agreement, the Contractor and the Customer shall be liable in accordance with the current legislation of Ukraine.
6.2. The Contractor is not liable for damage caused to the life or health of the Customer in the event of improper fulfillment by the Customer of the requirements of the legislation of Ukraine, the terms of this Agreement, the Rules of residence at the hotel "Kyivska Russ Resort Medical&Spa", the requirements and instructions of the Contractor's employees.
6.3. The Contractor is not responsible for the safety of the Customer's personal belongings.
6.4. In case of complaints, the User must provide: a complaint, a check (receipt, etc.) to the Hotel, a document with the Hotel's mark confirming the violation of the terms of service, documents confirming actual losses. Complaints and all necessary documents are provided to the Hotel no later than 14 days from the date of completion of the service. All complaints are considered by the Hotel only if the Hotel was informed of the violation of the terms of service in advance so that they can be eliminated within the next 12 hours.
6.5. The hotel considers the received complaint within 20 days.
6.6. Complaints filed in violation of the requirements of the Public Offer (Agreement) will not be considered.
6.7. In the event that the parties to this agreement do not reach an agreement on the disputed issues voluntarily, the interested party has the right to go to court.
7. FORCE MAJEURE
7.1. The Parties shall not be liable under this Agreement if the inability to fulfill their obligations arises due to force majeure circumstances (force majeure circumstances) that are beyond the control of the Parties and are beyond their competence, which must be proven by the Party that refers to such circumstances. Such circumstances include, in particular, military events, natural disasters, strikes and other similar circumstances. The document confirming the force majeure circumstances is a certificate from the Chamber of Commerce and Industry at the location of the relevant Party.
8. OTHER CONDITIONS
8.1. The Agreement shall enter into force from the moment of acceptance of the public offer and shall remain in effect until its termination.
8.2. By accepting and concluding this Agreement, the Customer confirms that he has been provided with and understands all information related to the provision of services under this Agreement.
8.3. By accepting, the Customer automatically consents to the processing of his personal data by the Contractor, i.e. to the performance of the following actions in relation to the Customer's personal data: collection, systematization, entry into the Contractor's databases, including electronic ones, accumulation, storage, clarification, as well as further use and distribution by the Contractor of the Customer's personal data in accordance with the provisions of the Law of Ukraine "On Personal Data Protection" No. 2297-VI dated 01.06.2010 (as amended), and also confirms that he has been notified by the Customer of his rights as a personal data subject, personal data controller, the purpose of data collection, the composition and content of the collected personal data, as well as other persons to whom personal data may be transferred.
